Legal Status Of CBD Around The World

Legal Status of CBD around the World

The legality of Cannabis, Marijuana and/or their derivatives CBD and THC varies from country to country. Cannabis laws around the world vary in the areas of possession, distribution, cultivation, how it can be consumed, and what medical conditions it can be used to treat.

But there is more to know. While cannabis might be illegal in some parts of the world, its derivative CBD – the focus of this article – is often legal for use for health and wellness purposes.

Because hemp is sometimes confused with marijuana, there is still some stigma towards hemp-derived CBD. However, from a legal perspective, hemp-derived CBD is legal and possession should pose no legal issues in most of the United States and many countries, but it is important to understand how the law around CBD use and possession works in whatever country you find  yourself.

Hemp-derived CBD is the only type of CBD that is legal in most countries. CBD is also found in the marijuana plant. Marijuana-derived CBD is not legal in most countries because the growth and cultivation of marijuana are not legal.

In this article, we will be looking at the legality of hemp derived CBD in selected countries across the world.

It is worthy to note that while medical cannabis and its derivative CBD is legal in all 50 states that make up the Union, the substance remains a class A drug federally and possession of the substance is in clear violation of federal laws. A bit tricky you might say, but that’s the reality of most cannabis control regulations in the United States.

CBD Laws in Europe

In Europe, marijuana and cannabis laws differ from country to country. While the general EU law permits the consumption of CBD products containing no more than 0.2% THC, there are a few exceptions such as Croatia, and Slovenia, etc; that applies an outright ban to all cannabis and cannabis derived substances including CBD.

Germany

CBD and medical cannabis are legal substances in Germany and have been so for over 2 years now. Patients requiring CBD are expected to get a marijuana card and doctors prescription for their medications.

While recreational cannabis remains illegal, Germany holds a liberal stance on the private and public consumption of the substance.

Italy

Italy legalized cannabis for medical use in 2007, with many caveats. In the 1940s, Italy was said to be the world’s second-biggest producer of industrial hemp, but after World War II, the country adopted a different approach to the cultivation of hemp, banning the business completely. In 2017 , a government directive shifted the perspective by no longer requiring authorization for cultivating hemp with a maximum THC content of 0.2% with a tolerance level up to 0.6%. CBD Oil was Legal in Italy as long as the product had less than 0.6% THC. High CBD cannabis strains were also available in Italy in smokeable form, commonly called Cannabis Light. However, in June 2019, the Supreme Court outlawed so called "Cannabis Light" as the Interior Minister put the pressure on to shut down CBD shops. The verdict means that the sale of cannabis light is prosecutable but no formal change of legislation has happened yet, so we should not expect all stores to shut immediately; that will depend on local enforcement.

Bulgaria

Bulgaria made history by becoming the first EU country to allow free sale of hemp-derived cannabidiol. Tis makes CBD products legal and easy to purchase in Bulgaria, as long as they contain less than 0.2% of THC.

Cyprus

Cyprus follows the EU regulations and allows cultivation of hemp. Any products manufactured from this plans must not exceed 0.2% of THC, making regular CBD products legal to purchase.

Czech Republic

Hemp derived CBD is legal to purchase as long as it has less than .3% THC (higher than EU limit of .2%THC).

Austria

In Austria the legal situation regarding CBD is a bit more complicated than in Germany, cannabis flowers and extracts  containing CBD can be legally sold, but not as a food supplement or medication and the maximal content of THC allowed is 0.3%.

France

France is the largest producer of hemp in Europe, mostly used for hemp paper. It is unclear whether CBD oil is legal in France. France follows the general EU law for industrial hemp and allows legal purchase of CBD products with content of 0.2% THC or less. However, in 2018,  french health authorities shut down "CBD cafes" and sent out a directive clarifying regulation surrounding CBD products: "Products, and especially CBD-based e-liquids are prohibited if they contain THC regardless of the rate and if they are not obtained from varieties and part of authorized plants." France stated that "the .2% THC limit principle exists in order to allow the use of hemp for industrial and commercial purposes".This directive would seem to indicate that only CBD products with 0% THC are legal for sale/consumption, inconsistent with EU standards.

Greece

According to Greek law, hemp-derived products are not considered as drugs, as they do not contain high amounts of THC. Therefore, CBD products can be legally purchased in Greece as long as they contain .2% or less of THC.

Ireland

Pharmacies and stores in Dublin have started selling CBD products which contain less than 0.2% of THC. This is because of the recent amendments to Irish law, which have recognized CBD (hemp-derived CBD) as a non-cannabis product, making it legal. These oils and products must be developed according to HPRA and EU standards to be accepted in the market.

Finland

While CBD products in Finland are legal, they are regarded as medicine, therefore require prescription. Importing CBD products form abroad is also not easy and heavily regulated.

Denmark

While cannabis derived CBD is legal, there are controlled measures with prescriptions. Marijuana remains an illegal substance in Denmark and when reprimanded would cost you a small fine or on a heavier note, a prison sentence of up to 2 years depending on the quantity in your possession at the point of arrest.

Danish laws unequivocally prohibit the cultivation, processing, sale and or distribution of marijuana. However, only recently (January 2018) whole plant for medical and wellness purposes was made legal for a 4 years pilot.

To become eligible to purchase and use a control quantity of the substance in Denmark, you would require a written prescription from your licensed health care provider.

Sweden

Sweden has some of Europe’s most restrictive drug laws. There are currently no specific laws about CBD in Sweden yet, so CBD is in a gray zone here. CBD is not classified as a medicine, but the medical agency is currently working on classifying it as medicine. Classifying CBD as a medicine needs to be tried in court first and the process will take a long time.According to EU laws, CBD products cannot contain more than 0,2% THC and this applies to Sweden as well. However, a recent court ruling (June, 2019) provided clarification that while hemp is excluded from the definition of cannabis, and therefore is not considered a drug..a preparation containing THC does not meet this exception and is therefore considered a drug.  (https://www.nutraingredients.com/Article/2019/07/24/Sweden-s-Supreme-Court-outlaws-sale-of-THC-containing-CBD-oil)

Norway

CBD oil is widely accepted in Norway. The Norwegian Parliament decriminalized personal drug use in December 2017.  As long as there’s 0% trace of THC, CBD is legal. Norway is not a part of the European Union, which has a .2% THC limit. It is legal to use and possess CBD only if it is prescribed by a doctor.

The Netherlands

CBD oil is legal in the Netherlands as long as it was produced outside of The Netherlands and contains less than the legal concentration of 0.2% THC in its formulation.

The United Kingdom

Cannabis remains illegal in the United Kingdom although the government has made some concessions on the dispensary of medical cannabis. While the UK remains strongly averse to the idea of legalized cannabis, growing public concerns and agitation is likely to shift the pendulum in the nearest future.

Legal Status Of CBD Around The World

Canada

In Canada, as in the US, hemp flower with THC of less than .3% is legal as long as it complies with the regulations set forth in the Cannabis Act.

South Africa

In May the South African Health Minister amended the country’s Medicines and Related Substances Act, 1965, to remove certain cannabidiol preparations for nonserious health claims. The change to South Africa’s medicines law means the country is the first in Africa to carve out a federally approved market for nonprescription CBD.The rule change pertains to preparations that contain a maximum daily dose of 20 milligrams of CBD and that contain not more than 0.001% of THC and not more than 0.0075% total CBD.

Asia

Many countries in Asia have some of the strictest cannabis laws in the World.

Japan

In Japan, cannabis possession alone can land you a five year prison term with 7-10 years for cultivation, sale, and transport. Surprisingly, CBD oil IS LEGAL in Japan. However, it has to contain absolutely 0% THC.

China

While the consumption of CBD has not yet been authorized in China, this hasn't stopped some states in the Country from cashing in on the cannabis boom and cultivating cannabis to produce CBD oil. To produce hemp in China requires, among other things, approval from the police to insure that the plant is bred with less than .3% THC. This is difficult to enforce in theory, as you won't know the % of THC until the hemp is harvested. China is another country with some of the strictest drug enforcement policies in the world. Cultivating and using marijuana in China are strictly forbidden, and it's uncertain whether or not CBD will be legal for use in food or medicines any time soon. Currently China permits the sale of hemp seeds and hemp oil and the use of CBD in cosmetics.

South Korea

South Korea was the first country in east Asia to legalize Medical Cannabis in November, 2018. CBD oil is legal but strictly for medical purposes from a short list of approved drugs.

Thailand

In August, 2019 the Ministry of Public Health took CBD off of the Narcotics list as long as it is 99% pure and contains no more than .01% THC by weight. This oil can be derived from cannabis or hemp as long as there is less than .01% THC. Thailand currently bans imports of 99%-pure CBD oil made from cannabis for a period of five years from the date the regulation came into effect on September 2, 2019. Any imports during that time will be considered a narcotic. While CBD oil made from cannabis is illegal to import, there is no ban on imports of CBD oil made from hemp.

Singapore

The Republic has an absolute zero tolerance position on drugs. There may be a health case for CBD in Singapore despite the harsh drug policies. In February, the Health Ministry and the Ministry of Home Affairs commented that it was vital to distinguish between compounds containing unprocessed illicit substances and medically useful supplements with cannabinoids. In other words, any material with scientific evidence backing its efficacy and safety for the body might not be considered illicit. Currently, the country is exploring medical treatments and the utility of CBD.

India

The laws in India are very unclear. Growing hemp is allowed only with special permission. It is said, that cannabis medicines are allowed and legally available under the AYUSH ministry as Ayurvedic medicine. It is advised to be careful when importing/exporting any products that are made from hemp/cannabis

Latin America Embraces Hemp-based CBD Oil

Several Latin American countries have relaxed their laws surrounding cannabinoids, including non-psychoactive cannabidiol (“CBD”).

Mexico

Mexico in days would join the league of countries that have fully legalized the cultivation, processing, sale, possession, and use of Cannabis and cannabis derivatives. This has come on the heels of an October, 31st 2018 Supreme Court ruling.

However, the laws since 2015 have been a little relaxed with medical CBD for the treatment of degenerative ailments such as cancer and Parkinson disease.

Brazil

Brazil has been a long-time opponent of cannabis legalization, but in April 2014, the country and its regulatory authority ANVISA legalized CBD for therapeutic uses. Currently, the government has approved the import of hemp-based CBD oils for epilepsy, Parkinson’s disease, and chronic pain, including migraine headaches.

The following list is a list of countries that we know do allow CBD Oil from Hemp:

United States

Argentina

Austria

Belgium

Belize

Brazil

Bulgaria

Canada

Chile

Colombia

Costa Rica

Croatia

Cyprus

Czech Republic

    Good morning

I hope this email finds you well. I would like to contribute a CBD edibles article to your site thecbdplugs.co.uk. It would be great if you could add my details to the bio along with a link to vapelifemag.com.

    Here it is!

    The Ultimate CBD Edibles Guide

Also known as cannabinoids, CBD refers to hemp content contained in the cannabis plant. Along with other cannabinoids, CBD takes the lion share of the cannabis herb. People can use cannabinoids in various ways when it is extracted from the cannabis herb, but this depends on what it contains. Tetrahydrocannabinol (THC) and CBD are the famous cannabinoids, and each has different effects.

The Difference between THC and CBD

THC edibles differ from CBD edibles in a few ways. First, CBD edibles are legal according to federal law. However, CBD edibles may sometimes contain low traces of THC, but it should not exceed 0.3 percent, which is the required threshold. Contrary, THC is known for its high effect, which people often associate with cannabis sativa, a plant species under the family of cannabis plants. Another plant species under this family is hemp. CBD doesn’t induce the body and high mind-altering effects that are associated with THC. Instead, CBD extracts are obtained from the hemp herb, which is legal in many states. You can either vape, take orally, or put CBD topically. The exciting thing is that CBD doesn’t come with the psychotropic effect that THC is known for. The impact of THC on the mind and body are quite different, and state and federal law prohibits growing in many places. Though a few countries have already legalized the THC aspect for recreational purposes, many states are still yet to approve it.

CBD edibles are associated with energy and mood uplift. Edibles such as CBD cookies and chocolates are known for relieving stress and a variety of ailments. CBD edibles are a viable option for people with chronic conditions, where constant use of pain killers can impact their health negatively. It isn’t associated with the addictive qualities that various pharmaceuticals, such as THC contains, and it can even be used as a remedy for someone addicted to THC. Research has so far found little side effects of CBD edibles, and the benefits of its medicinal purposes are unmatched. In essence, CBD edibles are a natural option to relieve a set of mind and body-altering ailments.

What are the Uses of CBD Edibles?

You can use CBD edibles for various reasons. One way is that it has been used as a remedy to ailments such as inflammation, epilepsy, nerve pain, chronic pain, depression, symptoms of anxiety, and insomnia. Whether it is in the form of edible, vape as an oil, or take it topically as a lotion, CBD can be administered in different ways. CBD edibles are available in a wide range of form, including cooking oils, baked goods, and gummies. The popularity and rise of CBD continue to grow as people enjoy its benefits.

How Can Someone Enjoy CBD Edibles?

There are a set of different options for administering CBD edibles. It can be taken in the form of baked goods, capsules, pill, oils, or gummies. CBD edibles are safe for humans and pet purposes. Here are a few ways of taking CBD edibles.

    CBD Capsules and Pills

Capsules and pills are similar to taking prescription drugs, and it is a great route to consider if you have no issue with CBD edibles. CBD pills and capsules intake occurs in the same fashion as with capsule and medication vitamins. Just take the tablet or pill orally and give it time for its effects to manifest.

    CBD Gummies

Taking CBD in the form of gummies is one of the best ways to enjoy CBD edibles. Plenty of CBD gummies flavors are available, and some are reminiscent of the candy that you grew up enjoying.

    CBD Cooing Oil

Not all CBD oils are taken through vaping. Some come in the form of oil, where users can put a few drops in the mouth and consume them orally. Others are in the form of cooking oil, which people can use for cooking sweet dishes and savory.

    CBD Edibles for Pets

    CBD Oil For Cats

Injecting puppies and kittens with CBD hardly comes to our thoughts. However, recent studies have found that CBD edibles can improve the health of dogs and cats immensely. That’s because animals have the same endocannabinoid system like the one found in humans, and binding it with CBD edibles can help relieve anxiety and pain in animals as well. Pet owners whose dogs have been ailing for a while should consider administering CBD oil to help alleviate the pain and speed up recovery.

    CBD Oil For Dogs

Of course, we crave for baked cakes, and CBD cookies come in that form. Get treats such as brownies and cookies to take your CBD experience to another level.

    Tips for taking CBD Edibles

There are a few tricks to keep in mind when taking CBD edibles.

Beginners should start with a low dosage to assess how their bodies will react to it.

Then try to increase the dosage slowly as you monitor your body’s response.

Take time to research the oil or edible that you buy and confirm its potency and purity level. Keep off any CBD that has traces of THC, and shop around to find the best CBD for you.

Give the CBD time to work after having a heavy meal.

How to Choose the Right CBD Product or Edible?

Finding the right CBD edible is all about needs and preferences. It is up to the users to decide how quickly they would want the effects of their edibles to manifest. For example, CBD taken in an edible form can take longer to kick in because it depends on the kind of food and your digestion, but its effects are quicker when it is taken as a pill. It is up to you as well to determine whether you want something with fewer calories and sugary such as cookies and gummies. Another thing to consider when shopping for CBD is that the dosages of some edibles are higher than others. First, find out about whatever ailment you are trying to alleviate before picking your edibles. Some edibles or dosages work better for anxiety than others, while others are ideal for chronic issues and muscular pain. CBD lotions, Salve, and Cream are other options for taking CBD. You can apply Salve and Cream on a swollen or injured body part for alleviating pain. Though this is an alternative to utilizing CBD in edibles, capsules, and vaping, it still bears fruits when applied as stipulated. It is an option that users can use daily to alleviate chronic pain and handle stretch marks that are ailing them. Researching the available CBD products and which works the best for you can enable you to make the right decision for whatever CBD product or edible you would want to use.

    How CBD Edibles Work

You first have to understand how the endocannabinoid system in the human body works to know how the effects of CBD edibles kick in. Also known as ECS, the endocannabinoid system is a biological system within the human body, and it comprises of lipid-based neurotransmitters. Its role is to bind to the receptors of cannabinoids that are scattered throughout the central nervous system. The endocannabinoid system produces cannabinoids to regulate different aspects of the nervous system as well as inflammation in human beings. It can help regulate ailments, epilepsy, and pain. Cannabinoids occur in our bodies naturally, but boosting our organs with an external cannabinoid from CBD edibles can increase the positive effects within the endocannabinoid system. The role of the endocannabinoid system isn’t only to respond to internal cannabinoids, but the external cannabinoids as well. Response to external cannabinoids that come in the form of CBD edibles can help mediate inflammation and chronic pain. Science and different studies back up the benefits of CBD edibles, and it is one of the few available natural remedies.

    Edibles vs. Vaping CBD

CBD products are also available for use in vaporizers, but that depends on personal preferences. Some people prefer smoking while others use to take their CBD products in vape pens. Others may want to control their CBD intake by smoking instead of taking in the form of edibles. Taking CBD products in vape pens allows the effects to hit in a little quicker than taking them in the form of edibles. Vaping is a viable option for someone who would not want to wait for minutes or hours for the effects of CBD to kick in after eating. However, both edibles and vaping are discreet in a way, and the CBD will have the same results as long as the dosage remains the same.

    Incredible Benefits of CBD Edibles

    Long-Lasting Relief

CBD edibles have several benefits over gummies and CBD inhaled with vape pens. It can take a while for CBD edibles to take effect, but the results can last longer than vaping or smoking. CBD edibles combine the active compound of cannabinoids with other foodstuffs for better results. The digestive system releases CBD slowly as digestion takes place. The results might take longer to manifest, but they are long-lasting.

    Non-Psychotropic Effects

Of course, CBD is a compound of the cannabis sativa plant, but many people are surprised to find out that its psychotropic effects aren’t as high as THC. Instead, it offers users a sense of alerted energy and mellow mood uplift. Given its long-lasting nature, cookies and brownies infused with CBD can provide prolonged relief from everyday stressors and mild pains. It is an excellent option for anyone who would want to enjoy the effects of cannabis without any side effects.

    Easy to Make

Though some prefer making infused cooking oils and cannabutter, CBD edibles such as brownies and cookies are simple to make. You can even add CBD extracts to baked and cooked foods for an antioxidant boost. However, note that the effects of isolated CBD are less effective compared to the cannabis plant. You can now find CBD crystals made with isolated and purified CBD online and in access points. CBD edibles are easy to dose and can give a user more control over their CBD intake.

    Less Risk of Lung Irritation

Vape pens have become popular than ever, but their long-term implication is still yet to be determined. Thinning agents such as polyethylene and propylene glycol are also present in many vape pens. Research suggests that heating these thinning agents to temperatures above 224℃ can produce toxic carcinogens. Vape pens that don’t contain these thinning agents are available, but CBD edibles are an excellent option to avoid poisonous compounds.

    General Remedy

Researchers suggest that care physicians can use CBD in medicine. Several CBD-infused drugs have already proved successful in treating ailments, epilepsy, and pain in clinical trials. CBD doesn’t benefit people with chronic conditions only, but anyone else who consume it as well. However, it may not work well for people with ailments related to first-aid. Research has found that some CBD edibles work the same as over-the-counter remedies, and their side effects aren’t as harsh as some of the pharmaceutical drugs.

    Discreet

Some CBD forms are impractical or cumbersome. You could be using a large vape pen, and pulling it out in public may sometimes not be convenient. People who would want to boost their focus during the workday or relieve pain during a long flight can consider bringing with them a CBD gummy.

    Available Online

Online availability is another benefit of CBD edibles. Though regulations on CBD products are little strict, online CBD vendors across the United States can sell their products online and ship them anywhere. You can also find CBD products in a handful of European nations. Those edibles that are sold online are derived from the hemp plant. People often refer to cannabis when discussing a variety of plants that can produce THC. The hemp plant was used for seed and fiber, but it is now being applied to low-THC and high-CBD cannabis cultivars. Any cannabis with as low as 0.3 percent THC, which is the required threshold is considered hemp in the United States. Hemp products sold online contain less than 0.3 percent THC.
